The CCMA and polygraph testing

 

The CCMA’s position on polygraph testing is that polygraph results may be used as supporting evidence, but they cannot be relied on as the sole proof that an employee committed misconduct.

Commissioners assess the admissibility and reliability of the test, recognising that polygraphs indicate whether a person responded truthfully.

A failed polygraph does not automatically imply guilt, and an employee cannot be dismissed based on polygraph results alone.

 

Instead, the results may be considered alongside other evidence, such as access, opportunity, inconsistencies, or witness testimony, to determine the balance of probabilities in a case.

In short, the CCMA views polygraph testing as a useful investigative tool—but only when applied fairly, voluntarily, and in combination with additional credible evidence.
